Throughout these Terms, “we”, “us” and “our” refer to Staithes Candle Co. “You” and “your” refer to the person using our website or purchasing from us.

These Terms apply when you use our website or place an order with us. Please read them before ordering. Nothing in these Terms affects your statutory rights as a consumer.

Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to sell our products online.

2. Using our website

You may use our website only for lawful purposes. You must not misuse the website, attempt to gain unauthorised access to it, introduce malicious software or use it in a way that could damage the website or interfere with another person’s use of it.

You are responsible for ensuring that any information you provide when placing an order is complete and accurate.

3. Our products

We take reasonable care to describe and photograph our products accurately.

Because our products are handmade in small batches, slight variations in colour, finish, texture or appearance may occur. Colours may also appear differently depending on your screen and device settings. These variations do not affect your statutory rights if a product is faulty, damaged or not as described.

Product availability may change without notice. We may withdraw a product or limit the quantity available for purchase.

4. Orders and acceptance

When you place an order, you are making an offer to purchase the products in your basket.

You will receive an order confirmation email acknowledging that we have received your order. This acknowledgement does not mean that your order has been accepted.

A contract between you and Staithes Candle Co is formed when we send confirmation that your order has been dispatched.

We reserve the right to decline or cancel an order before dispatch. This may happen if a product is unavailable, payment cannot be authorised, there is an error in the price or description, or we reasonably suspect fraudulent or unauthorised activity.

If we cannot accept your order after payment has been taken, we will notify you and refund the amount paid.

Please contact us as soon as possible if you need to amend or cancel an order. We cannot guarantee that changes can be made after an order has been prepared or dispatched.

5. Prices and payment

All prices are shown in pounds sterling and include any applicable taxes unless stated otherwise.

Delivery charges are shown before you complete your order. The total amount payable will be displayed at checkout.

We take reasonable care to ensure prices are correct. If we discover an obvious pricing error before dispatch, we will contact you and give you the option to continue at the correct price or cancel the order for a full refund.

Payment must be authorised before an order can be accepted.

6. Delivery

Delivery options, charges and estimated timescales are shown on our website and at checkout.

We aim to dispatch orders within the times stated in our Shipping Policy. Delivery dates are estimates unless we have expressly agreed a specific date with you.

We are responsible for your order until it is delivered to you or to a person you have nominated to receive it. Risk in the products passes to you when you or your nominated recipient takes physical possession of them.

We are not responsible for delays caused by events outside our reasonable control. If a significant delay occurs, we will contact you as soon as reasonably possible.

Unless we agree otherwise with you, goods will be delivered within 30 days of the order being accepted.

7. Cancellations, returns and refunds

If you purchase online, you will normally have the right to cancel your order within 14 days of receiving it without giving a reason. After telling us that you wish to cancel, you normally have a further 14 days to return the products.

Your cancellation rights are subject to legal exceptions. These may include personalised or custom-made products and sealed products that are not suitable for return for health or hygiene reasons once their seal has been broken.

You may handle a product only as much as you reasonably would in a shop. We may reduce a refund if the product’s value has been diminished through unnecessary handling.

Where a cancellation right applies, we will refund the price paid and the cost of our least expensive standard delivery option. You are normally responsible for the cost of returning unwanted products unless we agree otherwise or the product is faulty, damaged or incorrect.

8. Faulty, damaged or incorrect products

Your products must be as described, of satisfactory quality and fit for their usual purpose.

Please contact us as soon as possible if your order arrives damaged, is incorrect or you believe a product is faulty. We may ask for photographs and proof of purchase so that we can investigate and resolve the problem.

Nothing in these Terms or our Refund Policy limits your statutory rights concerning faulty, damaged or misdescribed goods.

9. Product safety and use

Please read and follow all instructions, ingredients, warnings and safety information supplied with each product.

Candles, wax melts and home-fragrance products must be used only as directed and kept away from children, pets, heat sources and flammable materials.

For bath and body products, check the ingredient information before use if you have allergies or sensitivities. Follow the directions and cautions on the product label. Discontinue use if irritation occurs.

Our bath, body and wellness products are not intended to diagnose, treat, cure or prevent any medical condition. If you have a medical condition, are pregnant, are taking medication or are uncertain whether a product is suitable for you, seek advice from an appropriate healthcare professional before use.

10. Intellectual property

The content of this website, including our name, branding, product descriptions, photographs, graphics, videos and other original material, belongs to Staithes Candle Co or is used with permission.

You may view the website for personal, non-commercial use. You must not reproduce, distribute, modify, republish or commercially exploit our content without our prior written permission.

11. Third-party services and links

Our website may contain links to websites or services operated by third parties. We are not responsible for the content, availability or privacy practices of third-party websites.

Our store is hosted by Shopify. Purchases made through this website are made directly between you and Staithes Candle Co. Shopify provides the ecommerce platform but is not the seller of our products.

14. Events outside our control

We will not be responsible for a delay or failure caused by circumstances outside our reasonable control. These may include severe weather, transport disruption, postal or courier disruption, fire, flood, industrial action, failure of communications networks or other unexpected events.

If such an event affects your order, we will contact you and take reasonable steps to minimise the delay. Where the delay is substantial, you may be entitled to cancel and receive a refund for products not supplied.

15. Changes to these Terms

We may update these Terms occasionally to reflect changes to our business, website or legal obligations.

The Terms in force when you place your order will apply to that purchase. Updated Terms will not retrospectively change an existing contract.

16. Governing law

These Terms are governed by the laws of England and Wales.

If you live elsewhere in the United Kingdom, you retain any mandatory consumer protections that apply where you live and may be entitled to bring proceedings in your local courts.
